O objetivo deste trabalho é demonstrar que o regime democrático não é apenas condição sine quo non para concepção e preservação dos Direitos Humanos como atualmente concebidos, mas também é instituto do próprio Direito Fundamental dos indivíduos. Considerando isso, ainda será analisado o efeito interno das normas internacionais acerca da matéria, defendo seu efeito direto interno.
Resumo Inglês:
The purpose of this work is to demonstrate that the democratic regime is not only a sine quo non-condition to the conception and conservation of the currently conceived Human Right, but also an institute of individuals Fundamental Rights. Evaluating this, it will be analyzed as well the internal effects of the international law about this subject, defending its internal direct effect.
