O presente trabalho tem como principal objetivo analisar, em um contexto histórico e jurÃdico,
a evolução dos precedentes norte-americanos sobre a questão do aborto. Para tanto, foram
selecionadas três importantes decisões, proferidas em épocas diferentes, que refletem muito
bem a mudança de paradigma da Suprema Corte: Roe v. Wade (1973), Planned Parenthood of
Southeastern Pennsylvania v. Casey (1992) e Gonzales v. Carhart (2007).
This work aims to analise , in historic and forensic context, the precedent‟s evolution in the
United States concerning the abortion topic. To illustrate the point, three important decisions
have been selected, dealt out in different periods, which reflect the change in the Supreme
Court‟s paradigm: Roe v. Wade (1973), Planned Parenthood of Southeastern Pennsylvania v.
Casey (1992) e Gonzales v. Carhart (2007).
