Resumo Português:
O presente artigo parte de uma perspectiva histórica, em que o autor analisa o
processo penal, sua concepção, sua relação de complementariedade para com o
direito penal e sua função. Após analisa os sistemas processuais, quais sejam
inquisitório e acusatório, sendo que, ao final, tece crÃticas à concepção tradicional
do processo penal, e justifica sua orientação pelos ideais garantistas.
Resumo Inglês:
The present article has as starting point a historical perspective, where the autor
analyzes the criminal proceeding, its conception, its relation of complementarity
with the criminal law and its function. After analyzes the procedural systems,
which are inquisitorial and accusatory, and then, to the end, elaborate criticals to
the traditional conception of the criminal, and justify its orientation for the ideals
of guarantees.
