O artigo analisa as soluções encontradas pela Previdência Social dos Estados Unidos da América para lidar com o seu contencioso administrativo, um dos maiores do mundo. Após identificar as normas gerais que se aplicam às agências administrativas, o estudo apresenta como elas foram adaptadas pela Social Security Administration de modo a preservar as garantias jurídicas necessárias ao diálogo entre os cidadãos e a Administração Pública. Demonstra, em seguida, como a estruturação específica do procedimento administrativo repercute na revisão judicial das decisões dessa Agência. Ao final, avalia as vantagens do modelo adotado para solucionar litígios que envolvam entes públicos em condições similares.
The article analyzes the solutions found by the United States of America Social Security Administration to deal with its administrative litigation, one of the largest in the world. After identifying the general laws that apply to administrative agencies, the study presents how these norms were adapted by the Social Security Administration in order to preserve the legal guarantees necessary for citizens to dialogue with the public administration. It then specifies how the design of the administrative procedure affects the judicial review of the Agency's decisions, assessing the effectiveness of this model to resolve disputes involving administrative entities in similar circumstances.
