A Gêneses das Cortes Constitucionais dos Estados Unidos e do Brasil por meio de pesquisas empírica das matrizes constitucionais destas e da comparação da Suprema Corte dos Estados Unidos da América e do Supremo Tribunal Federal com a semelhança ou dessemelhança entre as duas Cortes. As funções dos Poderes das duas Cortes; a Suprema Corte americana existente há mais de dois séculos; o período histórico é a dessemelhança com o Supremo Tribunal Federal; os fatores sociais e o sistema de indicação dos Ministros nas Cortes . O preâmbulo das Constituições com o destaque do povo e os benefícios da liberdade na Suprema Corte Americana e o Estado Democrático de Direito, a segurança e a igualdade na Corte brasileira. A ausência da participação do povo no processo de indicação dos Ministros das Cortes, cuja decisões proferidas por essas têm sérias repercussão na sociedade.
Resumo Inglês:
The Genesis of the Constitutional Courts of the United States and Brazil through empirical research of their constitutional matrices and comparing the Supreme Court of the United States of America and the Supreme Federal Court to the similarity or dissimilarity between the two Courts. The functions of the State Powers, the American Supreme Court has existed for more than two centuries, the historical period is the dissimilarity with the Supreme Federal Court, that the social factors and the system of appointment of Ministers in the American Court. The preamble of the Constitutions with the highlight of the PEOPLE and the benefits of freedom and the highlight of the Democratic Rule of Law and security and equality. The absence of the people participation the process of nominating the Ministers of the Courts, whose decisions rendered by them have serious repercussions in Society.
