O texto tem como objetivo traçar a partir do contexto histórico do pós-guerra, como o Direito pode regular a conduta humana a partir da sua refundamentação, em que a pessoa ocupa o centro do ordenamento jurídico, em que o positivismo, para além de sua perspectiva formal, pode ser relido como sistema normativo de conduta humana globalmente eficaz, mas também, como fenômeno jurídico histórico e cultural que permite a consolidação do Estado a partir da Constituição, isto é, da ordem objetiva de valores que estrutura e constitui o Estado por meio da vontade de Constituição, e de como os Direitos Fundamentais se relacionam com o Direito Civil levando-se em conta a eficácia dos Direitos fundamentais nas relações entre particulares, a partir da tópica.
