Este artigo trata em torno da proteção jurídica da imagem por ser um tema de alto impacto para a promoção dos direitos fundamentais ao considerar que há o constante risco de ser violado, inclusive, em ambientes democráticos. Nesse contexto, argumenta-se a respeito da liberdade de expressão que foi disciplinada na revogada da lei de imprensa, em razão do julgado da ADPF130 conceber que houve a compatibilidade desta lei com a Constituição Federal de 88. Desse modo, ressalta-se o “caso dos Black Blocs”, uma vez que amparados pela Magna Carta à liberdade de expressão, e desamparados quanto ao anonimato e violência perante o patrimônio público e privado

This paper is about the law protection of the image to be a topic of high impact to the promotion of human rights when considering that there is the constant risk of being violated, even, in environments democratic. In this held, it is argued about the free speech that was disciplined in the repealed law of the press, the trial by reason of ADPF130 conceive that there was compatibility of this law with the Federal Constitution 88. Thus, we can analysis the case of the Black Blocs, once supported by the law of free speech, and helpless about anonymity and violence to the public and private equity.
