O presente artigo expõe as origens do Testamento Vital e explica brevemente o princípio de autonomia do paciente, em relação ao final de sua própria vida e o consentimento informado. Os objetivos dessa declaração expressa de vontade, sua forma, seu valor, bem como sua situação atual no mundo reacendem os debates éticos e filosóficos- existenciais sobre a problemática da Morte e do processo de morrer. Nesse contexto, o direito à vida ocupa um lugar central, ao mesmo tempo que o valor saúde, ao ser reconhecido como inerente à dignidade da pessoa humana e corolário do direito à vida, torna-se algumas vezes um dilema ético e moral. O sentido da morte não nos é ensinado. O autoengano do ser humano diante da morte levou-o a negá-la racionalmente.
Resumo Inglês:
The present article exposes the origins of the Living Will, and briefly explains the principle of patient autonomy in relation to the end of his own life and informed consent. The objectives of this express declaration of will, its form, its value, as well as its present situation in the world reignite the ethical and philosophical-existential debates on the problematic of Death and the process of dying. In this context, the right to life occupies a central place, while at the same time health value, when recognized as inherent in the dignity of the human person and a corollary of the right to life, sometimes becomes an ethical and moral dilemma. The meaning of death is not taught to us. The self-deception of the human being before death led him to deny it rationally.
