O presente trabalho discute a questão do trabalho escravo contemporâneo como contradição ao preceito constitucional que defende a dignidade da pessoa humana, valor inconfundível para os direitos humanos. Nesse ínterim, apresenta-se o trabalho digno como veículo de promoção da dignidade da pessoa humana e como rejeição de toda condição que reduza o homem à condição análoga ao trabalho escravo. Na sequência se insere os elementos para a caracterização jurídica do trabalho escravo e alguns julgados pelo STF para ilustrar a situação da atualidade da pesquisa. A dignidade da pessoa humana, sem dúvida, deve ser o valor intransponível de um Estado Democrático de Direito.
The present work discuss the thematic related to the contemporary labor slave as a contradiction of constitutional principles that defends the principles of the dignity of the human person being, unmistakable value to the human rights. In this interim, it is presented the Labor’s dignity as a way of promoting the human dignity and the rejection of all the conditions which reduce the human person to the labor analogous to slavery. In the sequence, it inserts the elements to the judicial characterization of labor slave and some who were judged by Federal Supreme Court (STF) as a way to illustrate the situation of the actual research. Undoubtedly, it must be the insurmountable value of a Social Democratic State of Law.
