Este artigo descreve e analisa criticamente o panorama jurídico da regulamentação da doação de órgãos por pessoas não relacionadas ao receptor, sob a perspectiva da literatura e jurisprudência sobre o conceito constitucional de entidade familiar. O principal objetivo do ensaio é investigar o que o direito pode fazer pela medicina nessa área, bem como o que a medicina pode fazer para aprimorar o direito em matéria de transplante de órgãos por doadores não relacionados. Conclui-se, ao final, que as restrições à doação de órgãos por doadores não relacionados são inconstitucionais, pois ignoram o conceito contemporâneo de entidade familiar e, ainda, que a interpretação dos profissionais do Direito e da Medicina deve evoluir para se adequar à nova realidade constitucional.
Resumo Inglês:
This article describes and critically analyzes the legal landscape of the regulation of organ donation by persons not related to the recipient, from the perspective of the literature and jurisprudence on the constitutional concept of family entity. It aims at investigating what law can do for medicine in this subject, as well as what medicine can do to improve the right to organ transplantation by unrelated donors. Finally, it is concluded that the restrictions on donation of organs by unrelated donors are unconstitutional, since they ignore the contemporary concept of family entity, and also that the interpretation of Law and Medicine professionals must evolve to suit the new constitutional reality.
