Todo comportamento humano pode ser considerado sob perspecti-vas éticas e jurídicas. Com o espantoso desenvolvimento técnico-científico, notadamente no campo biomédico, cada vez mais e cada vez maiores se apresentam as exigências de proteção e de responsabilidade global sobre o patrimônio genético humano e o meio ambiente. A recente Lei 13.123, de 20.05.2015, regulamenta os incisos II do § 1º e 4º do art. 225 da Constituição Federal, entre outros. Todavia, não menciona em seus dispositivos o patrimônio genético humano. Sua natureza jurídica e tutela serão objeto deste estudo.

All human behavior can be considered from ethical and legal perspectives. Whit the astounding technical and scientific development, particularly in the biomedical field, more and increasing the protection requirements and global responsibility about the genetic heritage of humanity and the environment. The recent law n. 13.123/ 20 may 2015, regulates article 225, II, § 1º and 4º, among others– Brazilian Constitution and others Brazilian laws. However does not mention in its device the genetic heritage of humanity. Its legal nature and protection will be the subject of this study.
