A justaposição de jurisdições foi uma caracterÃstica fundamental da monarquia e das formas de organização social no Antigo Regime português. Os diversos corpos sociais que formavam a sociedade, como os órgãos do governo, encontravam-se em constantes conflitos de jurisdição, devido à s sobreposições de funções ocasionada pela polÃtica singular da Coroa portuguesa. Estes conflitos de jurisdição estenderam-se por todo o Ultramar, sobretudo nas capitanias da América portuguesa. Este trabalho propõe-se a analisar o conflito de jurisdição ocorrido entre o capitão-mor do Rio Grande, José Pereira da Fonseca, e o provedor da Fazenda Real, José Soares, no ano de 1726.
Overlapping jurisdiction was a central feature of the monarchy and forms of social organization in the Portuguese Ancient Regime. The various governing bodies that shaped society, such as government agencies, faced constant conflicts of jurisdiction due to the overlapping of functions that were a result of the singular policy of the Portuguese Crown. These conflicts of jurisdiction were common in all Portuguese colonies, especially in the captaincies of Portuguese America. This study aims to analyze the conflict of jurisdiction between the captain-major of Rio Grande, José Pereira da Fonseca, and the Royal treasurer, José Soares, in the year of 1726.
