Este artigo revisa o princÃpio da proibição de retrocesso social à luz da relação entre cidadania (mecanismo jurÃdico-polÃtico de inclusão), justiça distributiva e igual respeito e consideração, assumindo uma igualdade de oportunidades ex ante. Conclui-se que, diante da hierarquia entrelaçada juiz-legislador, o retrocesso social, ofensa ao mandamento de distribuição de renda, só se concretiza com a aplicação do direito, não podendo ser puramente atribuÃdo ao legislador.
This work rethinks the principle of prohibition of social retrocession in the context of the relationship citizenship-distributive justice-equal concern and respect, in a context of equality of resources ex ante. We concluded the tangled hierarchy between judges and legislators impose that social retrocession, an offense prohibited by a norm which makes income distribution a must, can only be concrete when one judges a case, being inadequate to solely blame legislators for it.
