O artigo situa a crise do Estado Democrático de Direito e a constante fragilização do Texto Constitucional brasileiro (talvez em seu momento mais crítico), tanto no aspecto estrutural dos Poderes do Estado como em relação ao dirigismo e controle político pretendido pela Constituição segundo o constitucionalismo contemporâneo, no iluminador debate entre “os fatores reais de poder” de Ferdinand Lassalle no século XIX e a “força normativa da Constituição” de Konrad Hesse do segundo pós-guerra, textos clássicos da teoria política e do direito constitucional que travam, em suma, o debate entre o real e o normativo, entre o poder e o direito.
Resumo Inglês:
The article situates the crisis of the Democratic State of Law and the constant weakening of the Brazilian Constitutional Text (perhaps in its most critical moment), both in the structural aspect of the State Powers and in relation to the dirigism and political control intended by the Constitution according to contemporary constitutionalism, in the illuminating debate between Ferdinand Lassalle's “real power factors” in the nineteenth century and Konrad Hesse's “normative force of the constitution” of the second post-war, classical texts of political theory and constitutional law that, in short, constitute the debate between the real and the normative, between power and law.
