Este artigo apresenta considerações a respeito da Análise Econômica do Direito, com enfoque principalmente no papel das instituições. Inicialmente, aborda o movimento conhecido como Institucionalismo e, em seguida, o Neoinstitucionalismo. Neste último são apreciados os estudos de Douglass North e Oliver Williamson. O objetivo é contribuir para a interpretação da intervenção do Estado na economia.
This article presents some thoughts regarding the Law and Economics, by focusing primarily on the role of the institutions. Initially it approaches the movement known as Institutionalism, and then the Neoinstitutionalism. In this one the studies of Douglass North and Oliver Williamson are analyzed. The purpose is to contribute to the interpretation of the State Ìs intervention in economy.
