Com o advento do Novo Código de Processo Civil, verifica-se, no ordenamento jurídico brasileiro, um movimento de valorização do precedente judicial, no sentido de reconhecer sua autoridade, aproximando-se do sistema de precedentes judiciais obrigatórios do common law. O presente artigo pretende oferecer conceitos úteis para a compreensão desse complexo ambiente que está se formando no Brasil. Dar-se-á, todavia, especial atenção ao sistema de precedentes vinculantes trazidos pelo Código de Processo Civil e à influência que a Inteligência Artificial poderá exercer nas formações destes precedentes.
With the advent of the New Code of Civil Procedure, there is a movement in the Brazilian legal system to appreciate the judicial precedent in order to recognize its authority, approaching the system of mandatory judicial precedents of common law. The present article intends to offer useful concepts for the understanding of this complex environment that is being formed in Brazil. However, special attention will be given to the system of binding precedents brought by the Code of Civil Procedure and the influence that Artificial Intelligence can exert on the formations of these precedents.
