O trabalho em questão visa, portanto, analisar as obrigações extraterritoriais das Partes Contratantes do PIDESC no contexto de operações de cooperação para o desenvolvimento que possam comprometer o gozo dos direitos humanos através das fronteiras. Após o exame detalhado de alguns casos especificamente relacionados às atividades de financiamento do desenvolvimento bilateral e aos efeitos sobre os direitos econômicos, sociais e culturais das populações beneficiárias, a análise enfocará brevemente a questão da responsabilidade do Estado pela violação dos direitos humanos em terceiros países através de organizações internacionais e instituições financeiras. Pode-se prever que, se a prática de cooperação para o desenvolvimento derivada das decisões do Comitê de Direitos Econômicos, Sociais e Culturais (CESCR) e os outros órgãos de monitoramento ativos nas Nações Unidas fornecem indicações relativamente significativas. A natureza das obrigações estatais nas atividades de cooperação bilateral, os respectivos compromissos das Partes Contratantes do Pacto Internacional sobre Direitos Econômicos, Sociais e Culturais, no contexto da participação em instituições ou organizações internacionais, permanecem difíceis de verificar e identificar.
The work in question therefore aims to analyze the extraterritorial obligations of International Covenant of Economic, Social and Cultural Rights (ICESCR) Contracting Parties in the context of development cooperation operations that could jeopardize the enjoyment of human rights across the border. Following the detailed examination of some cases specifically related to bilateral development financing activities, and to the effects on economic, social and cultural rights of the recipient populations, the analysis will focus briefly on the issue of state responsibility for the violation of human rights in third countries through international organizations and financial institutions. It can be anticipated that if the development cooperation practice derived from the rulings of the Committee on Economic, Social and Cultural Rights (CESCR) and the further monitoring bodies active in the United Nations provides relatively significant indications. The nature of state obligations in bilateral cooperation activities, the respective commitments of Contracting Parties of International Covenant on Economic, Social and Cultural Rights in the context of participation in international institutions or organizations, however, remain difficult to verify and identify.
