A proposta deste artigo é analisar as fronteiras que se delineiam, a partir de mecanismos jurídicos e práticas sociais, entre a liberdade e a escravidão. Numa abordagem que se insere no campo da história social da escravidão, reconstituiremos o processo pelo qual a liberdade foi entendida, usurpada e reivindicada por vários sujeitos sociais. Para tanto, buscaremos desvendar as tramas dos costumes e da justiça institucionalizada na província do Ceará, no século XIX. O corpus documental que permite tal investigação é formado, dentre outras fontes, pelos relatórios dos presidentes de província e informações jornalísticas de O Cearense 1846 a 1884, no qual a escravização ilegal e a precariedade da liberdade eram temas recorrentes.
The purpose of this paper is to analyze the boundaries that delineate, through legal mechanisms and social practices, between freedom and slavery. An approach which fall within the field of social history of slavery, we‟ll reconstitute the process by which freedom was understood, usurped and claimed by various social actors. Thus, we will seek to unveil the habit plots and the institutionalized justice in province of Ceara, in the nineteenth century. The documentary corpus that allows such investigation is formed, among other sources, by the reports of the provincial presidents and journalistic information of the “O Cearense” from 1846 to 1884, in which the illegal enslavement and the precariousness of liberty were recurring themes.
