Trata-se de trabalho realizado acerca dos acidentes de trânsito ocorridos no País e de suas trágicas consequências. Analisa-se a gravidade da atual situação do trânsito e apresentam-se algumas medidas a serem tomadas com o intuito de amenizá-la, dentre as quais está a aplicação das normas penais aos causadores dos eventos danosos em alusão. Estuda-se, outrossim, quais são as referidas leis que dispõem sobre condutas típicas praticadas na direção de veículo automotor e aponta-se que o aspecto subjetivo da conduta do motorista será responsável pela capitulação legal de sua ação criminosa. Desta forma, os elementos volitivos dolo e culpa são contrastados, para que se busque a melhor maneira de interpretar os casos concretos. O crime de homicídio perpetrado por condutor influenciado por bebida alcoólica é a conduta escolhida e analisada. Objetiva-se concluir se, nesses casos, o indivíduo age com dolo eventual ou culpa consciente, para, consequentemente, ser possível apontar em qual normal penal tal ação deve ser emoldurada. É feito um levantamento dos posicionamentos doutrinários e de decisões judiciais sobre o assunto. Assim, após um confronto das citadas teses, desenvolve-se um raciocínio argumentativo e, ao final, afirma-se o mais apropriado enquadramento jurídico da conduta em comento.
This study aims to analyse traffic accidents occurred in Brazil and their tragic consequences. It also examines the seriousnessof the traffic situation and presents some steps that may be taken with the purposetolighten effects of this context, which one of those is the application of the criminal laws to the responsible agent of the referencedharmful events. This study aimstoanalyse too which laws treat about criminal conducts perpetrated in automotive vehicle driving and indicate that the subjectiveaspect of the driver’s conduct will determinate the legislation that is going to be used in the specific case. Thus, the subjective elements malice and fault are contrasted with the intentionto find the best way to interpretthe particularevents. The crime of murder practiced by a driver that drank alcoholic beverageis the chosen and analysedconduct. The article aimsto concludeif in those cases the person acts with “dolus eventualis”or “conscia culpae”and,therefore,point wich criminal law has to be applied. It was made a study of the doctrinal positions andthejudicional decisions about this issue. Then, after a confrontation of those theses, an argumentative reasoning is developed and, at the end, is affirmed which is the bestlegal environment of the conduct mentioned above.
