O acesso à Justiça deve incluir formas diferenciadas para os povos indígenas devido ao reconhecimento pluricultural da Constituição de 1988 e Convenção n.º 169 da OIT. O objetivo do artigo é refletir o acesso à Justiça dos povos indígenas diante do necessário diálogo com o Novo Constitucionalismo Latino-Americano.
Access to justice should include different ways for indigenous peoples due to pluricultural recognition of the 1988 Constitution and Convention 169/ ILO. The objective of this article is to reflect on access to justice for indigenous people in Amazon State with relation to the necessary dialogue with the New Latin American Constitutionalism who created the concept of indigenous jurisdiction. The research methodology is qualitative, with data collection documentary and bibliographical, it was observed for indigenous Amazon difficulties with both little access and jurisdiction denying their rights, factors that resulted in the conclusion of a dominant colonial justice in the region studied.
