O presente artigo analisa a principal diferença entre os sistemas penais acusatório e inquisitório, qual seja: o lugar do juiz. Em seguida, analisa o papel das partes dentro do processo penal existente, à luz das mudanças tratadas pela Lei nº 13.964/19, para, ao final, averiguar a importante atuação da Defensoria Pública na realidade brasileira e o esforço imprescindível para a realização dos objetivos fundamentais da República trazidos no art. 3º, III, da CR.
The presente article analyzes the main difference between the criminal procedural systems accusatory and inquisitorial, which is: the judge’s place. After, it analyzes the parties’ role on the current criminal procedure, in the light of the changes dealt by the Law n. 13.964/19, in order to, at the end, comprehend the important role of the Public Defense into the brazilian reality and the essential efforts to achieve the fundamentals objectives of the Republic, brought in art. 3rd, III, CR.
