O presente trabalho analisa a legitimidade que os juízes têm, em um sistema de controle difuso como o argentino, para o exercício do controle constitucional. São analisadas as críticas feitas a essa legitimidade democrática e como são superadas quando o sistema atende a determinados requisitos. Analisa-se também a necessidade, pelo menos nessas latitudes, de um sistema de controle adequado para evitar transbordamentos de órgãos políticos.
This paper analyzes the legitimacy that the judges have, in a diffuse control system like the Argentine one, for the exercise of constitutional control. Criticisms of this democratic legitimacy and how they are overcome when the system meets certain requirements are analyzed. It also analyzes the need, at least in these latitudes, for an adequate control system to avoid overflowing of political bodies.
