O presente trabalho trata sobre os indícios de inconstitucionalidade que podem obstar a implementação do sistema de governo parlamentarista no Brasil. Para tanto, o trabalho inicia com uma descrição sobre a teoria da separação de poderes e sua égide no ordenamento jurídico do país, bem como versa quanto à origem e às características dos sistemas presidencialista e parlamentarista. Por fim, analisa a relação do parlamentarismo com a cláusula pétrea da separação de poderes, bem como a limitação ao poder de reforma enfrentada pelas Propostas de Emenda à Constituição para sua implementação.
Resumo Inglês:
This paper deals with the indications of unconstitutionality that may impede the implementation of the parliamentary system of government in Brazil. To do so, the work begins with a description of the theory of separation of powers and its aegis in the legal system of the country, as well as the origin and characteristics of the presidential and parliamentary systems. Finally, it analyzes the relation of parliamentarism with the petrea clause of the separation of powers, as well as the limitation to the reform power faced by the Proposed Amendments to the Constitution for its implementation.
