O artigo aborda a importância de compatibilizar o direito de indústria com o direito à salubridade no meio ambiente industrial do trabalho, a partir dos referenciais dos estudos sobre o meio ambiente industrial sustentável e a saúde do trabalhador desse meio ambiente. Partimos de dois fenômenos principais: (1) a complexidade jurídica que envolve a atividade industrial; e (2) os aspectos de salubridade do meio ambiente onde a atividade é exercida, refletindo na saúde do trabalhador. Após essa etapa, é realizada uma análise crítica entre a atividade industrial potencialmente poluidora perante as exigências legais e sociais, a produção sustentável e a resistência de seus colaboradores em se adaptar e incorporar essas exigências comportamentais no seu dia a dia. Por fim, uma análise crítica sob em que medida isso tem repercutido efetivamente na vida dessa parcela de trabalhadores. Com esses subsídios, constatamos algumas das problemáticas que se colocam aos profissionais que testam os cigarros.

The article discusses the importance of reconciling the right to industry with the right to health in the industrial working environment, based on the references of the studies on the sustainable industrial environment and the health of the workers of this environment. We start with two main phenomena: (1) the legal complexity involved in industrial activity; and (2) the health aspects of the environment where the activity is carried out, reflecting the health of the worker. After this stage, a critical analysis is carried out between the potentially polluting Industrial activity in relation to the legal and social requirements to the sustainable production and the resistance of its employees in adapting and incorporating these behavioral demands in their day to day, and, finally, an analysis critical to the extent to which this has effectively impacted the lives of this portion of workers. With these subsidies, we see some of the problems that are faced to professionals who test cigarettes.
