Trata-se de manifestação acerca de consulta encaminhada à Comissão de Constituição e Justiça e de Cidadania da Câmara dos Deputados sobre a possibilidade de reeleição na presidência da Casa Parlamentar. Ocorre que, por meio da hermenêutica jurídica, acompanhando entendimento de doutrinas clássicas sobre o tema, pode-se falar que a correta interpretação do § 4º, do artigo 57, da Constituição Federal, não deve ser literal. Desse modo, conclui-se pela possibilidade de parlamentar que exerceu mandato-tampão disputar novamente o mesmo cargo na Mesa Diretora.

This is a manifestation about a referral to the Constitution and Justice and Citizenship Committee of the Chamber of Deputies about the possibility of reelection in the presidency of the Parliamentary House. It happens that, through legal hermeneutics, accompanied by the understanding of classical doctrines on the subject, it can be said that the interpretation of §4º of article 57 of the Federal Institution shouldn’t be literal. In this way, it’s concluded by the possibility of a parliamentary who has held a cap-mandate to again play the same position at the Presiding Board.
