O presente artigo tem por escopo analisar a evolução histórica do direito antitruste americano e os seus objetivos (preventivo e repressivo). Para tanto, será feita uma análise da economia e dos julgados americanos antes da vigência da Sherman Act com o intuito de compreender os fatores decisivos para a sua promulgação. Em seguida, após a entrada em vigor da Sherman Act, serão estudadas as principais decisões reconhecendo o caráter instrumental da concorrência e a finalidade das leis antitruste. Nesta toada, verificar-se-á a importância da adoção conjunta de políticas tanto de prevenção quanto de repressão das condutas anticompetitivas.
Resumo Inglês:
This article aims to comment the historical evolution of American antitrust law and its objectives (preventive and repressive). In order to do so, it will provide an analysis of the American economy and decisions before the Sherman Act came into force so as to understand the decisive factors for its promulgation. Then, following the entry into force of the Sherman Act, major decisions will be considered recognizing the instrumental nature of competition and the purpose of antitrust laws. In this regard, the importance of the joint adoption of policies for both prevention and repression of anti-competitive behavior will be verified.
