O presente artigo trata a respeito da sucessão internacional que possui o aspecto “multiconectado” e, por isso, permite o conflito que é feito entre as leis dos países em que estão situados os bens do de cujus, para que seja possível escolher qual lei que será aplicada na sucessão. No direito brasileiro, afirma-se que a sucessão de bens de estrangeiros situados no país será regulada pela lei brasileira em benefício do cônjuge ou dos filhos brasileiros, sempre que não lhes seja mais favorável a lei pessoal do de cujus. Um ponto relevante é que o Direito Internacional Privado regulamenta a vida social das pessoas privadas implicadas na ordem internacional.
Resumo Inglês:
The presente article deals with the international sucession that has the aspect “multiconected” and, therefore, allows a conflict that is made among the laws of the countries in which the assets of the deceased are situated so that it is possible to choose which law will be applied in the sucession. In the Brazilian law, it is stated that the succession of foreign assets located in the country will be regulated by the Brazilian law for the benefit of the spouse or of the Brazilian children, whenever the personal law of the deceased is not more favorable to them. A relevant point is that the Private International Law regulates the social life of private people involved in the international order.
