O artigo discute o papel do direito no regime militar brasileiro (1964-1985), especialmente a partir da relação entre regra e exceção. São abordadas as várias transformações jurídicas realizadas ao longo do regime ditatorial por meio do uso de instrumentos como o ato institucional e a emenda constitucional. A ambiguidade entre essas formas é desenvolvida.
This paper addresses the role played by the legal system in the Brazilian military regime (1964-1985), focusing on the relationship between rule and exception. The significant legal transformations carried out during the dictatorial regime are addressed with the use of legal tools such as institutional acts and constitutional amendments. The ambivalence between these forms is developed and analyzed, with attention to the concrete processes of constitutional change.
