Objetivo: analisar a atuação do Supremo Tribunal Federal na Ação Direta de Inconstitucionalidade 26 e Mandado de Injunção 4733, verificando existência de Ativismo Judicial e possíveis ofensas à separação de poderes. Materiais e Métodos: o presente estudo foi conduzido por meio de uma pesquisa bibliográfica, descritiva e qualitativa, tendo como embasamento obras doutrinárias e artigos científicos referentes ao Ativismo Judicial, Criminalização da homofobia, Controle de Constitucionalidade e Separação de poderes. Resultados: o poder judiciário atua politicamente acerca de competências originais do poder Legislativo ao determinar a criminalização da homofobia e transfobia. Conclusão: a manifestação do STF decorre de provocação legítima realizada através dos institutos previstos para a realização do Controle de Constitucionalidade.
Objective: To analyze the performance of the Federal Supreme Court in the Direct Action of Unconstitutionality 26 and Injunction Order 4733, verifying the existence of judicial activism and possible offenses against the separation of powers.Material and Methods: The present study was conducted through a bibliographic research with a transversal, descriptive and qualitative approach, having as theoretical basis doctrinal works and scientific articles referring to Judicial Activism, criminalization of homophobia, Control of Constitutionality and separation of powers.Results: The judiciary acts politically on the original powers of the Legislative when determining the criminalization of homophobia and transphobia. Conclusion: The manifestation of the STF arises from a legitimate provocation through the institutes responsible for realizing the constitutionality control
