Este presente artigo trata-se sobre a aplicabilidade da recomendação 62/2020 do CNJ no inquérito penal em
face da prisão preventiva, no contexto da pandemia da Covid-19, que resultaram em diversas mortes e uma
grande falta de amparo no quesito saúde para a população. Diante da calamidade, o Conselho Nacional de
Justiça se viu com o dever de trazer sugestões aos magistrados em atuação na esfera penal, sobre os critérios
de contingência da Covid-19 nos estabelecimentos prisionais, instruindo-os a adoção de medidas preventivas
à propagação da infecção através de ações socioeducativas. Considerando também a existência do grupo de
risco. O qual carece e de uma maior atenção, que convém destacar os presos, que convivem aglomerados
devido a estrutura física e do número de prisões preventivas nos presídios brasileiros.
