O presente artigo possui como temática central a Convenção Internacional sobre os Direitos das Pessoas com Deficiência, a qual representa uma conquista social das pessoas com deficiência, tendo em vista a previsão de diversos direitos como acesso à saúde, à educação, ao trabalho; o combate aos atos discriminatórios, bem como a inclusão, acessibilidade e igualdade de oportunidades. Delimitou-se a pesquisar sobre a luta pelo reconhecimento das pessoas com deficiência dentro da sociedade civil juntamente com o impacto da Convenção na tutela jurídica internacional desses indivíduos. Destacou-se a vigência e a efetividade do tratado no ordenamento brasileiro, haja vista que a ratificação da Convenção e promulgação da Lei Brasileira de Inclusão alterou radicalmente algumas normativas presentes, sendo possível perceber uma negligência do País em relação à garantia aos direitos dessas pessoas, principalmente referente à educação inclusiva, visto que exige medidas sócio-jurídicas e políticas para a sua proteção. Nessa senda, o estudo utilizou-se do método dedutivo, tendo em vista a análise de um objeto geral para o específico. Em referência ao procedimento técnico, realizou-se tanto um levantamento documental com a análise de tratados internacionais e legislações internas, bem como o levantamento bibliográfico, com a leitura e sistematização de livros doutrinários, além de artigos científicos publicados sobre o tema. Não obstante, apesar da proteção aos direitos das pessoas com deficiência ser garantida pela Convenção Internacional foi observado, na prática, que os principais obstáculos em relação à efetividade referente à educação, tanto do tratado quanto da lei brasileira, ainda estão presentes na sociedade civil.
This article revolves around the International Convention on the Rights of Persons with Disabilities, which represents a social achievement for individuals with disabilities, considering its provision of various rights such as access to healthcare, education, and employment; the fight against discriminatory acts, as well as inclusion, accessibility, and equal opportunities. The research was delimited to explore the struggle for the recognition of people with disabilities within civil society along with the impact of the Convention on the international legal protection of these individuals. The validity and effectiveness of the treaty in the Brazilian legal system were highlighted, given that the ratification of the Convention and the enactment of the Brazilian Inclusion Law radically altered some existing norms, revealing a negligence of the country in guaranteeing the rights of these individuals, especially concerning inclusive education, which requires socio-juridical and political measures for its protection. In this regard, the study employed a deductive method, analyzing from a general object to the specific. Regarding the technical procedure, both documentary research involving the analysis of international treaties and domestic legislations, as well as bibliographic research, including the reading and systematization of doctrinal books and scientific articles published on the subject, were carried out. Nevertheless, despite the protection of the rights of persons with disabilities being ensured by the International Convention, it was observed in practice that the main obstacles regarding the effectiveness of education, both from the treaty and the Brazilian law, are still present in civil society.
