Este artigo tem como proposta caracterizar o artigo 68 do Ato das Disposições Constitucionais Transitórias (ADCT) - como mecanismo fundamental de reparação e proteção do patrimônio cultural representado pelas comunidades remanescentes de quilombos no Brasil, transformando grupos até então silenciados por sofisticados mecanismos de violência simbólica em sujeitos de direito. Desta forma, estabelece-se não apenas o direito à propriedade da terra, mas, e ainda mais importante, a inserção destes como protagonistas da própria história, tendo seu papel e importância reconhecidos pelo Estado, seja por meioda agenda jurÃdica, seja pela sua derradeira inserção na história e na identidade oficial do paÃs.
This article aims to characterize the Article 68 ADCT as a fundamental mechanism of reparation and protection of cultural heritage represented by the quilombos remaining communities in Brazil, turning groups so far silenced by sophisticated mechanisms of symbolic violence in subjects of rights. Thus, it establishes not only the right to land ownership, but, even more importantly, the inclusion of these as protagonists of their own history, and their role and importance recognized by the State, either through legal agenda, either through their ultimate inclusion in the official history and identity of the country.
