A “IDEOLOGIA DE GÊNERO” COMO OBSTÁCULO AO DIREITO FUNDAMENTAL À EDUCAÇÃO E À IGUALDADE DE GÊNERO

O presente artigo tem por objetivo, à luz do direito fundamental à educação e da igualdade e não-discriminação entre mulheres e homens, trazer uma análise e reflexão ao que se tem denominado “ideologia de gênero” nas políticas de ensino. Tem havido uma série de iniciativas no campo da educação e especialmente a vedação expressa nos Planos Municipais de Educação a qualquer forma de abordagem a gênero ou orientação sexual nas escolas. O Supremo Tribunal Federal tem examinado a questão em alguns julgados de forma a afastar os referidos obstáculos trazidos por esse ativismo, porém as ofensivas se ampliam remanescendo sobre a questão muitos desafios para educadores e educandos.

This article aims, in the light of the fundamental right to education and of equality and non-discrimination between women and men, to bring an analysis and re-flection to what has been called “gender ideology” in teaching policies. There have been a series of initiatives in the field of education and especially the prohibition expressed in the Municipal Education Plans for any form of approach to gender or sexual orientation in schools. The Supreme Federal Court has examined the issue in some judgments in order to remove the referred obstacles brought about by this activism, however the offensives are widening remaining on the issue many challenges for educators and students.
