A “VÍTIMA PERFEITA” PARA O DIREITO PENAL BRASILEIRO

O presente artigo se propôs a analisar e compreender de que modo a representação de uma “vítima perfeita” incutida no imaginário social brasileiro pode ser construída pelo próprio Estado que, por sua vez, influencia a construção de uma cultura da violência contra a mulher. O objetivo central do trabalho foi o de responder à seguinte pergunta: em que medida a ausência de perspectiva de gênero no sistema de justiça reforça a visão da “vítima perfeita” nos crimes cometidos com violência (sexual ou não) contra a mulher? Foi adotada como metodologia de pesquisa a análise bibliográfica, com o levantamento e a análise de doutrina e produções acadêmicas existentes acerca das questões suscitadas. As conclusões alcançadas indicam que, no combate à violência contra a mulher, uma atuação estatal sem perspectiva de gênero fica vulnerável a reproduzir as violações já sofridas pela vítima, acabando, em verdade, por insuflar a violência contra a mulher e incutir no imaginário social a mensagem de que mulheres são categorizáveis e, a depender do contexto, seus corpos são passíveis de violência legítima.

Resumo Inglês:
This article aims to analyze and understand how the representation of an “ideal victim” instilled in the Brazilian social imaginary can be constructed by the State itself, which, in turn, influences the construction of a culture of violence against women. The main objective was to answer “to what extent does the absence of a gender perspective in the justice system reinforce the vision of the “ideal victim” in crimes committed with violence (sexual or not) against women?”. As research methodology, bibliographic analysis, survey and analysis of doctrine and existing academic productions on the issues raised were adopted. The conclusions reached reflect that, in the fighting against violence towards women, state action without a gender perspective is vulnerable to the reproduction of the violations suffered by the victim, ending up, in fact, instilling violence against women and instilling in the social imagination the message that women are categorizable and, depending on the context, their bodies are subject to legitimate violence.
