Pelo uso de metodologia racional-analítico estudou-se o juiz das garantias face aos princípios constitucionais, em principal o princípio do juiz natural, fazendo a análise das eventuais violações deste instituto jurídico, pontuando seus conceitos e fundamentos jurídicos, para que assim seja possível analisar a aplicabilidade constitucional do juiz das garantias no sistema jurídico brasileiro, para tanto a análise do princípio do juiz natural, como a ratio legis e aplicabilidade e implementação do instituto ao sistema jurídico vigente se faz imprescindível para a fixação de parâmetros da análise pretendida, sempre tendo em mente a observância aos dizeres constitucionais pátrios e aos preceitos jurídicos fundamentais.

By using the analytical-rational methodology studied the garantee judges before the constitutional principles, in main the natual judge principle, doing the analysis of eventual breach of this legal institute, for that point your concept and legal elements, so that so by possible understand the constitutional application of the garantee judges in the brasilian legal system, therefore are necessary understand the natural judge principle as ratio legis and applicability and implamentation of the institute before the actual legal system, therefore indispensable to the setting of parameters for intended analysis, always looking to vernacular constitutional rule and to fundamental legal principles.
