Considerando que os conflitos ambientais levados ao sistema de justiça, por muitas vezes tramitam muito lentamente e, que, a resolução demanda uma velocidade maior para a sua solução, este estudo procura entender se existe suporte legal interno e base internacional para que a arbitragem seja utilizada como alternativa para a resolução de conflitos ambientais no brasil. Para tanto, tem como objetivo geral, investigar se a arbitragem pode ser aplicada as questões ambientais em território brasileiro, uma vez que este país tem firmado acordos e tratados internacionais para aplicação do instituto em demandas que envolvem o meio ambiente. O método utilizado para o desenvolvimento deste estudo é o dedutivo e o de abordagem será o bibliográfico, com pesquisa em obras, artigos, documentos legais. Ao final, como resultado do estudo, constata-se a previsão legal para aplicar o instituto da arbitragem nas demandas ambientais no Brasil, da mesma forma como ocorre internacionalmente, segundos protocoles e convenções internacionais.
Considering that environmental conflicts brought to the justice system often proceed very slowly and that resolution requires greater speed for their solu-tion, this study seeks to understand whether there is internal legal support and an international basis for arbitration to be used. as an alternative for resolving environmental conflicts in brazil. Therefore, it has the general objective of inves-tigating whether arbitration can be applied to environmental issues in Brazilian territory, since this country has signed international agreements and treaties for the application of the institute in demands that involve the environment. The method used for the development of this study is the deductive and the approach will be the bibliographic, with research in works, articles, legal documents. In the end, as a result of the study, there is a legal provision to apply the arbitration institute in environmental demands in Brazil, in the same way as it occurs internationally, according to protocols and international conventions.
