Este artigo analisa aspectos da vinculação de precedentes no âmbito do Supremo Tribunal Federal, à luz de uma leitura política e moral da Constituição pelos membros da Corte. Perpassa sobre o papel da jurisprudência no sistema de civil law, a transcendência dos motivos determinantes, além de discutir alguns instrumentos de estabilização de precedentes. Analisa também o papel da reclamação constitucional no overruling e no distinguishing, em relação às decisões da Suprema Corte. O trabalho tem o intuito de chamar atenção para o fato de que existem instrumentos de vinculação de precedentes no sistema constitucional brasileiro, mas eles não estão se mostrando suficientes para cumprir o seu papel.

This article analyzes aspects of binding precedents within the scope of the Brazilian Federal Supreme Court, from a political and moral reading of the Constitution by the members of the Court. The role of jurisprudence in the civil law system is discussed, as well as the transcendence of ratio decidendi, and some instruments of stabilization of precedents. This article also analyzes the role of “constitutional complaint” in overruling and distinguishing Supreme Court decisions. The objective is to draw attention to the fact that there are binding precedent instruments in the Brazilian constitutional system, but that they are not proving sufficient to fulfill their role.
