O presente artigo visa compreender a origem do constitucionalismo, suas correntes e relações com a democracia e suas crises. Além disso, pretende compreender o constitucionalismo feminista como uma nova forma de pensar o Direito, rompendo com a dominação masculina vigente. A partir de revisão bibliográfica, conclui-se que o Estado de Direito somente será igualitário se estiver fundado em uma matriz político-jurídica emancipatória e feminista.
This article aims to understand the origin of constitutionalism, its currents and relations with democracy and its crises. Furthermore, it intends to understand feminist constitutionalism as a new way of thinking about Law, breaking with the current male domination. From a bibliographic review, it is concluded that the rule of law will only be egalitarian if it is founded on an emancipatory and feminist political-legal matrix.
