No presente trabalho, propomo-nos a analisar criticamente o processo desencadeado na Europa a partir da última guerra mundial, especialmente pela presença gravitante que têm cumprido as novas Constituições no terreno jurídico e também político-institucional. Ao mesmo tempo, resulta forçoso vincular essa inquietante e atual realidade com a chamada teoria neoconstitucionalista que lhe serve de respaldo e desenvolvimento. Ao realizar a análise utilizando centralmente a Europa, fazemos pensando na tradicional e sempre forte influência que desperta o velho continente no nosso. Somos herdeiros daquela cultura e as mudanças que ela vive não nos podem resultar indiferentes.

In this work we intent to critically analyze the process started in Europe since the last world war, specially for the gravitating presence that the new constitutions have accomplished in the law field, as well as in the political-institutional field. At the same time, it is necessary to link this disturbing and contemporary reality with the so-called neoconstitutional theory, which supports and develops it. Performing the analysis using Europe as center, we do so thinking about the traditional and always strong influence that the old continent arises in ours. He are heirs to that culture, and the changes that it sustains can not happen unnoticed
