The aim of the present essay is to analyze the scope and eventual compatibility with the Portuguese Legal System, of the recent doctrinal developments referring to the limits between the “dolus eventualis” and the “conscious negligence”, in particular with regard to the crime of “receiving” typified by the Article 231, n. 2, of the Penal Code, a problem that stands out even more when it is understood as a exclusively intentional crime, conception accepted by increasingly expressive doctrine and jurisprudence. Therefore, from a deductive method and having as theoretical referential the doctrine and jurisprudence from Germany, Spain and Portugal, it is intended to analyze the dogmatic evolution of the theme, evaluating critically the main models elaborated in the scope of the “cognitive”, “volitional” and “meaningful” theories of the “dolus”, to then examine their possible uses regarding to the conduct of “receiving”, typified by the article 231, n. 2.
