A Constituição Federal, em seu art. 5º., inciso LXVII, estabelece que "não haverá prisão civil por dívida, salvo a do responsável pelo inadimplemento voluntário e inescusável de obrigação alimentícia e a do  depositário infiel".  Durante muito tempo permitiu-se  à prisão civil daquele que não cumpria fielmente com sua obrigação de conservar determinada coisa com zelo e diligencia necessária. O instituto da prisão civil do depositário infiel é fruto de grande perplexidade jurídica estando sub judice nos autos do Recurso Extraordinário nº. 466.343-1/SP.  O presente trabalho tem por escopo defender a inconstitucionalidade dessa espécie de prisão civil, frente a três prismas: 1º) A soberania dos acordos e tratados internacionais; 2º) A eficácia das normas constitucionais; e o 3º) O principio da proporcionalidade e da dignidade da pessoa humana.

The Federal Constitution, in his art. 5, Item LXVII, states that "there will be no imprisonment for civil debt, unless the default of the voluntary obligation of food and the depositary infidel." For a long time led to the civil prison of what not to faithfully fulfilled its obligation to keep certain things with zeal and diligence. The Office of the depositary infidel civil imprisonment is the result of great perplexity legal file is sub judice in the Extraordinary Appeal no. 466.343-1/SP. This work has the scope to defend the constitutionality of that sort of civil prison, as opposed to three prisms: 1) The sovereignty of international agreements and treaties; 2) Effectiveness the constitutional requirements; and 3) The principle of proportionality and of human dignity
