O presente artigo pretende conferir se o Direito Penal pode serutilizado como instrumento idôneo de tutela contra a difusão defake newsno Brasil. A análise se desenvolveu a partir do conceito defake news, dosdanos causados pela sua disseminação e da constatação de que há umaaparente lacuna normativa no ordenamento jurídico brasileiro. Com isso,foi possível concluir que, embora o Direito Penal possa ser uma ferramentapara a contenção dos referidos danos, eventual criminalização das fake news depende, necessariamente, da observância da função do Direito Penal, dos seus princípios informadores e dos direitos e garantias constitucionais.
This study intends to verify if the Brazilian Criminal Lawcan be used as a suitable instrument of protection against the spread of fakenews in Brazil. This analysis is developed from the concept of fake news, the damage caused by its dissemination and the finding that there is an apparent gap in the Brazilian Law system. There after, it was possible to conclude that,although Criminal Law could be a tool able to contain the damages mentioned,the criminalization of fake news necessarily depends on the observance ofthe function of Criminal Law, its informing principles and the constitutional rights and guarantees.
