O Estatuto da Criança e do Adolescente assegura ao adotado, desde 2009, o direito de acessar suas origens. Entretanto, diferentemente de outros países, no Brasil ainda não houve debates sobre a dimensão de tal direito, que inclui a possibilidade de conhecimento e contato com a família biológica. Em relatos de filhos adotivos, a busca às origens tem se configurado como uma questão central e atual, demandando, portanto, a realização de mais estudos e reflexões sobre o tema. Devido à relevância da problemática, o presente artigo investiga a amplitude do direito de acesso às origens no contexto da adoção, enfocando a demanda de mediação endereçada ao Poder Judiciário em procedimentos referentes à busca das origens nas adoções nacionais. Para atingirmos tal objetivo, apresentamos uma ilustração de um caso ocorrido em uma das Varas da Infância e da Juventude do Estado do Rio de Janeiro, no qual a genitora procurou o Judiciário, a fim de estabelecer contato com a filha, que fora entregue para adoção havia mais de 30 anos. A discussão foi elaborada a partir de entrevistas posteriores realizadas com os envolvidos, abordando a intervenção da Justiça no caso. Percebemos que a inexistência de um protocolo específico para situações dessa natureza quase inviabilizou a intervenção técnica que propiciou o contato entre as famílias. Por fim, argumentamos a importância de uma sistematização no atendimento às demandas de acesso às origens, quer iniciadas pelos filhos adotivos, quer pela família biológica.

Since 2009, the adoptees’ right to access their origins is assured by law in Brasil. However, unlike other countries, there have not yet been debates about the scope of this right, which includes the possibility of knowledge and contact with the biological family. In reports of adoptees, the search has been configured as a central and current issue, demanding, therefore, the realization of more studies and reflections on the subject. Due to the relevance of the problem, this article investigates the amplitude of the right to access origins in the context of adoption, focusing on the claims for mediation addressed to the Judiciary in procedures referring to the search for origins, in national adoptions. In order to achieve this objective, we present an illustration of a case that took place at one of the Juveniles Courts of the State of Rio de Janeiro, in which the mother sought the Judiciary in order to establish contact with her daughter, who had been voluntarily relinquished 30 years ago. The discussion was based on later interviews carried out with those involved, focusing on the intervention of the Judiciary in the case. We realized that the lack of specific protocols for situations like this one almost made the technical intervention that provided contact between families impossible. Finally, we argue the importance of systematizing the procedures to receive demands of access to origins, whether initiated by the adoptee or by the biological family.
