A Ditadura Militar foi um marco na luta pelo respeito aos Direitos Humanos na América Latina e na derrubada de governos democráticos. Assim, na pesquisa desenvolvemos comparações e análises dos Direitos Fundamentais em duas Constituições – argentina e brasileira. Portanto, o presente trabalho tem como objeto de estudo a análise dos direitos fundamentais na américa latina e uma crítica sobre a resposta dos dois países, Brasil e Argentina, que sofreram com a Ditadura Militar partido das seguintes indagações: como reagiram após as graves violações da dignidade da pessoa humana? Qual país puniu de maneira efetiva os agentes dos sofrimentos e torturas humanas? Foi iniciativa do próprio Estado de ir em busca de justiça pelas atrocidades cometidas? Ou foi a Corte Interamericana de Direitos Humanos que impôs uma busca pela verdade?
The Military Dictatorship was a milestone in the fight for respect for Human Rights in Latin America and overthrow of democratic governments. Thus, in the research we developed comparisons and analysisof Fundamental Rights in two Constitutions -Argentine and Brazilian. Therefore, the present study has as its object the study of fundamental rights in Latin America and a critique of the response of the two countries, Brazil and Argentina, which suffered from the military dictatorship following the following questions: how they reacted after the serious violations of dignity of human person? Which country has effectively punished the agents of human suffering and torture? Was it the State's own initiative to seek justice for the atrocities committed? Or was it the Inter-American Court of Human Rights that imposed a search for the truth?
