O presente artigo coloca à reflexão e análise crítica a intervenção do Estado moçambicano no mercado, tendo em conta os pressupostos inerentes ao seu papel entanto que órgão interventor após a vigência do governo de transição e posterior aprovação da Constituição da República Popular de Moçambique e a aprovação da lei no 5/76 de 5 de fevereiro de 1976 – lei das nacionalizações. Outrossim, o artigo faz igualmente uma apreciação do novo papel do Estado Moçambicano como órgão regulador, aquando da vigência do fenómeno da privatização das empresas Estatais que teve sua gênese após a entrada em vigor da lei no 15/91 de 3 de agosto – lei da Reestruturação do Sector Empresarial do Estado, igualmente considerada como causa principal da criação das agências reguladoras independentes. Ademais, o artigo descreve os principais pilares do mercado que se submetem ao Estado como regulador, e outros sobre os quais o Estado pode assumir a posição de empresário sob o pretexto de eficiência económica no exercício de seu papel de promotor de bem-estar social.

The present article reflects upon and critically analyses the intervention of the Mozambican State in the market, taking into account the assumptions inherent to its role as an intervening body after the approval of the Constitution of the Popular Republic of Mozambique and the approval of law no. 5/76 of 5 February 1976 - the nationalization law. Furthermore, the article also assesses the new role of the Mozambican State as a regulatory body, during the privatization of State companies which took place after law no. 15/91 of August 3 - the Restructuring of the State Business Sector law - came into effect. This law is also considered to be the main cause for the creation of independent regulatory agencies. Hence, the article describes the main pillars of the market that are subject to the State as regulator, and others on which the State may assume the position of entrepreneur under the pretext of economic efficiency in the exercise of its role as promoter of social welfare.
