Apresentamos duas diferentes posições adotadas para proteger reclusos durante a pandemia do coronavírus: para a contenção no espaço prisional em Portugal foram criados institutos visando a libertação antecipada, enquanto no Brasil a ausência de política de proteção dos direitos e garantias resultou no crescimento da mortandade dos reclusos no país.
The article presents two different positions regarding the protection of prisoners during the coronavirus pandemic: Portugal created legal institutes towards the early release of inmates, containing the virus in prisons, whereas Brazil has an absence of policies aimed at protecting rights and guarantees, consequently increasing the national mortality of inmates.
