O presente estudo tem como objeto a exposição e análise das garantias e direitos fundamentais e sua relativização nos estabelecimentos federais do Estado Brasileiro, considerando suas características e passando pela exposição de novas medidas restritivas dissonantes da ordem constitucional e dos tratados de Direitos Humanos dos quais o Brasil é signatário. E neste último ponto identificamos a justificativa da relevância temática. A inclusão e manutenção de presos em estabelecimentos penais não deveria romper os laços familiares, sobretudo porque a família tem sua unidade constitucional garantida. Além disso, a legislação garante aos presos o respeito à integridade física e moral. A metodologia de pesquisa utilizada é bibliográfica e de campo. O objetivo geral deste trabalho é demonstrar a fundamentação legal garantidora de direitos dos apenados nos presídios federais brasileiros. Os objetivos específicos são: expandir o debate acerca do tema a fim de compreender a evolução histórica de conquistas de direitos nesta área bem como colaborar com a exposição, a fim de somar vozes pela efetivação dos direitos e garantias fundamentais nesses estabelecimentos. Dentre as conclusões, destaque-se que a custódia no Sistema Penitenciário sem a observância de direitos essenciais gera alta afetação da integridade psicofísica dos detentos, submetendo-os a malefícios que não se limitam à privação de liberdade.

The present work has as object of study the exposition and analysis of the guarantees and fundamental rights in and your federal State establishments relativization Brazilian, considering their characteristics, through the exhibition of new measures dissonant restrictive constitutional order and Human Rights Treaties of which Brazil is a signatory. And this last point we identify the rationale of thematic relevance. The inclusion and maintenance of prisoners in penal institutions shouldn’t break the family ties, especially since the family has your guaranteed constitutional unit. In addition, the legislation guarantees prisoners due respect the physical and moral integrity. The research methodology used is bibliographical and field. The general objective of this work is to demonstrate the rationale for guaranteeing legal rights for apenados in federal prisons. The specific objectives are: to expand the debate on the subject in order to understand the historical evolution of human rights achievements in this area as well as collaborate with the exhibition, in order to add voices for the effectuation of the fundamental rights and guarantees in these accommodation. One of the conclusions of this study, highlighted that the custody in the prison system without the observance of essential rights generates high affectation of the psychophysical integrity of prisoners, subjecting them to the evils that are not limited to deprivation of liberty.
