O presente artigo convida os leitores a estudarem os principais acontecimentos históricos sociais da década de 1930, entre eles a Ditadura, a Revolução de 1930 e a Revolução Constitucionalista de 1932, que influenciaram na elaboração das Constituições de 1934 e 1937. Por conta desses fatos sociais, procuramos neste trabalho delinear as diferenças e as semelhanças entre as referidas Cartas Políticas, que mesmo outorgadas sob forte influência de um regime autoritário e fascista estabeleceram importantes direitos e garantias à população brasileira. Por derradeiro, incitamos nossos leitores a pensar sobre a importância da história na formação do Direito, enquanto norma de conduta social.
This article invites readers to study the main social historical events of the 1930s, including the Dictatorship, the Revolution of 1930 and the Constitutionalist Revolution of 1932, which influenced the elaboration of the Constitutions of 1934 and 1937. On account of these social facts, we seek in this work to delineate the differences and similarities between the mentioned Political Letters, which even granted on the strong influence of an authoritarian and fascist regime established important rights and guarantees for the Brazilian population. Ultimately, we urge our readers to think about the importance of history in the formation of law as a standard of social conduct.
