O presente trabalho tem o escopo de apresentar um diagnóstico razoável dos problemas atuais na gestão municipal dos resíduos sólidos, ao mesmo tempo, analisar, dentro da legislação pertinente, os mecanismos e políticas previstos para a solução desses problemas, tais como a implementação de sistema de logística reversa, fiscalização de atividades potencialmente nocivas ao meio ambiente, adoção de aterros sanitários, em substituição aos antigos “lixões”, além de investimento em educação ambiental da população. O administrador público municipal brasileiro conta com a possibilidade de realizar convênios com associações de catadores, implantação de coleta seletiva, formalização de consórcios públicos para a construção de aterros sanitários, sem olvidar os programas previstos em bancos estatais, e auxílios do Ministério do Meio Ambiente. As opções de abordagem dos problemas relativos ao saneamento básico são várias, cabendo ao administrador municipal uma atitude proativa e sempre dentro da legalidade.

The present work aims to introduce a reasonable diagnosis of the current problems in the municipal management of solid waste, and at the same time to analyze, within the pertinent legislation, the mechanisms and policies foreseen to solve these problems, such as the implementation of a reverse logistics system, the inspection of activities potentially harmful to the environment, the use of landfills in order to replace the old “dumps”, in addition with investments in environmental education of the population. The brazilian’s city mayor has the the possibility to demand specific fees for the cost of these services, being able to make agreements with associations of garbage collectors, implementing of selective waste management, formalization of public consortium for the construction of landfills, without forgetting the aid programs provided by banks, and the support from the Ministry of the Environment. There are several options for addressing problems related to basic sanitation, being important that the municipal manager has a proactive attitude and always on legal grounds.
