O presente artigo analisa os impactos advindos da tecnologia e da inovação disruptivas, mostrando a atual realidade em que o fluxo de informação constitui o valor máximo da existência e que conduziu à reconfiguração da concepção de ser humano diante dos avanços da neurociência aliados à machine learning. Tem como objetivo analisar o modelo de sandbox regulatório, implementado em 2021 no Brasil pelo Banco Central, e que consiste na permissão dada por reguladores financeiros para que as empresas testem ideias inovadoras no mercado com consumidores reais. Questiona-se, pois, se o modelo de sandbox regulatório conduz à ética consequencialista, cuja atividade estaria focada nos resultados. Para tanto, utilizando-se do método dedutivo, por meio de uma análise qualitativa, pautando-se em pesquisa bibliográfica e documental, conclui-se que, com o emprego de direito de caráter construtivista, é possível conciliar o ser humano, sintonizado com a dignidade da natureza humana e na busca do justo com as interações da tecnologia.

This article analyzes the impacts arising from disruptive technology and innovation, showing the current reality in which the flow of information constitutes the maximum value of existence and which led to the reconfiguration of the concept of human beings in the face of advances in neuroscience combined with machine learning. Its objective is to analyze the regulatory sandbox model, implemented in 2021 in Brazil by the Central Bank, which consists of the permission given by financial regulators for companies to test innovative ideas in the market with real consumers. It is questionable, therefore, if the regulatory sandbox model leads to consequentialist ethics, whose activity would be focused on results. Therefore, using the deductive method, through a qualitative analysis, based on bibliographical and documentary research, it is concluded that with the use of constructivist law, it is possible to reconcile the human being, in tune with dignity of human nature and in the search for the just, with the interactions of technology.
